1. 피고인 A 피고인은 2018. 6. 13. 23:17 경 순천시 C에 있는 ‘D’ 이삿짐센터 사무실에서 피고인의 지인과 피해자 B(51 세) 사이의 윷놀이 내기를 구경하다가 윷놀이 규칙에 관하여 말다툼을 하게 되었고, 피해 자로부터 욕설을 듣자 화가 나 주먹으로 피해자의 얼굴을 때리고, 양손으로 멱살 등을 붙잡고, 서랍 장 위에 놓여 있던 골프채의 끝부분을 휘어서 만든 위험한 물건인 갈고리를 집어들어 피해자를 때리려 하고, 피해자와 함께 사무실 밖으로 나가게 되자 사무실 출입문 옆에 놓여 있던 위험한 물건인 빈 소주병으로 피해자의 안면 부를 1회 내리쳤다.

2. 피고인 B 피고 인은 위 일 시경 위 사무실 안에서 위와 같이 피해자 A(47 세) 와 시비를 하다가 사무실 서랍 장 위에 있던 위험한 물건인 스테인리스 그릇을 움켜 쥔 오른손으로 피해자의 안면 부를 1회 때리고, 양손으로 멱살 등을 붙잡고, 피해자와 함께 사무실 밖으로 나가게 되자 바닥에 있는 위험한 물건인 지압용 나무를 집어 들어 피해자의 안면 부를 향해 휘둘렀다.
