1. The instant lawsuit shall be dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. On April 11, 2010, the Plaintiff: (a) was diagnosed as “the pressure frame of 11 chests” (hereinafter “instant injury”) due to the crashed accident while dismantling a retaining wall concrete installed at a construction site located in the Southern-gun, Southern-gun; (b) received medical care from the Defendant from April 11, 2010 to September 30, 201 after obtaining medical care approval.

On Apr. 27, 2010, the Plaintiff received respectively “vertetype surgery” at the C Hospital, “vertebrate removal and crypology surgery” at the Inhuman University Seoul Hospital on Jan. 20, 201, and “vertebrate removal and crypology surgery” on Feb. 10, 201.

B. On September 30, 201, the Plaintiff submitted a medical treatment plan to the Defendant and filed an application for extension of the period of medical care from September 5, 2011 to March 4, 2012. Accordingly, the Defendant decided on October 19, 201, following deliberation by the advisory society at the Seoul Regional Headquarters’s headquarters, to “the termination of medical treatment after medical care from September 5, 201 to January 31, 201”.

C. On January 31, 2012, the Plaintiff submitted to the Defendant a medical treatment plan stating that “A person needs to undergo outpatient treatment, such as medication, as he/she was in a state of not forming the bones between 10 and 12 after he/she performed an operation after scarcity 11, and scarcity 10 and 12, with respect to the instant injury and disease.”

Accordingly, on February 3, 2012, the Defendant notified the Plaintiff of the decision through “the notice of decision on examination of medical plans (industrial accident insurance card)” stating the following:

(1) Classification of the matters to be decided: Non-approval of the medical treatment plan: (1) Non-approval of the medical institution name. (2) The name of the medical institution in the Incheon Special Metropolitan City.
