Punishment of the crime

No one shall deliver, sell, forge, imitate, or possess a trademark identical or similar to another person's registered trademark on goods identical or similar to the designated goods of another person for the purpose of using or allowing another person to use such trademark on goods identical or similar to the designated goods.

On June 13, 2018, the Defendant sold 5,233 clothing 5,233 (a total of 929,56,000) bearing the trademark identical to the trademark of each trademark right holder, from the time to December 19, 2018, in shopping mall B of the Internet Open Market B, with the trademark right holder D and E (registration number G) registered with the Korean Intellectual Property Office, and thereby infringing on each trademark right holder’s trademark right by selling 5,233 (a total of 929,05,00) bearing the trademark identical to the trademark of each trademark right holder.

On January 25, 2019, the Defendant sold AD with the same pattern as the trademark registered with the Korean Intellectual Property Office (trademark registration number AC) to AE, and sold 38,000 won from around that time to February 14, 2019, the Defendant sold 34 clothes with the same pattern as the victim U’s trademark, as indicated in the attached list of crimes, to 31 times.
