피고인들은 성명을 알 수 없는 공범들 중 일부가 무작위로 대한민국에 있는 불특정 다수인들에게 전화하여 대출을 해 준다고 거짓말하여 통장 등 금융거래에 관한 접근 매체를 양도하도록 한 다음 무작위로 대한민국에 있는 불특정 다수인들에게 전화를 걸어 신용 대출을 해 준다고 거짓말을 하여 위와 같이 양수한 통장에 금원을 계좌 이체하도록 하는 방법으로 불특정 다수의 피해자들 로부터 금원을 편취하는 이른바 ‘ 보이스 피 싱’ 조직의 일원으로, 성명을 알 수 없는 자( 위 챗 아이디 H)( 이하 H이라고 한다.)

On January 3, 2017, a person whose fraud name of Defendant A and Defendant C was unknown makes a false statement by phone call to the victim I, stating, “I will make a credit loan, and receive a loan by credit card loan due to low credit rating.” On or around January 4, 2017, Defendant A and Defendant C calls again and calls for a credit loan if “I are the K director of a new bank, I will make a credit loan if I would make a repayment immediately to receive a loan,” and then, it would be a credit loan if I make a false statement to “I transfer a bank account to which I would be repaid,” and it is in the name of LA around January 11:55, 2017 from damage.
