A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

On December 22, 2014, the Defendant: (a) was delegated with the sale of the second floor building located in E from D; and (b) concluded a contract to sell the said building to F in an amount equivalent to KRW 390 million in total; (c) promised to receive payment after one year for the remainder of KRW 70 million; (d) but (e) was deemed to have sold KRW 320 million without notifying D thereof; and (e) thereafter, the Defendant attempted to write the appearance of the Defendant, such as transfer of the remainder of KRW 70 million in total to the Defendant for the purpose of directly receiving the remainder of the remainder of KRW 320 million.

1. Forging a private document;

A. On December 2016, the Defendant forged a contract for the transfer of a claim, entered as “D(I) J, 105 Dong 704, J, and 704” in the column for the transferor’s transfer of a claim by using a computer at the HD’s office located in Hacheon-si, Hacheon-si, the transferor’s “A(K) L” in the column for indication of a claim, “70,000,000 won per day of sale of real estate held by the transferor to F(M)” in the column for indication of a claim, and then kept in advance at the name of the said D’s name.

D’s seal was affixed.

As a result, the Defendant forged one copy of the contract for the transfer of bonds in the name of D, a private document on rights and obligations.

B. The Defendant, at the time and place specified in the preceding paragraph, was in receipt column of the “Notice of Claim Transfer” by using the computer at the time and place, and, at the same time and place, was in possession of the “Notice of Claim Transfer,” J, J, 105 Dong 704, J, J, and J, J, and J, 104, J, and J, 105 Dong 704, “in the column,” “A(O) in the transferee column,” and “A(O) in December 2016, respectively, kept in front of D’s name.

D’s seal was affixed.

Accordingly, the Defendant forged one copy of the notice of transfer of claim in the name of D, a private document on rights and obligations.

2. On February 17, 2017, the Defendant held the foregoing investigation document at Wangcheon-ro 21 (Guangdong-dong).
