A defendant shall be punished by imprisonment for seven years.

The defendant shall be ordered to complete the sexual assault treatment program for 80 hours.

Punishment of the crime

1. Violation of the Act on the Protection of Children and Juveniles against Sexual Abuse;

가. 피고인은 2010. 8. 중순 22:00경 경북 영덕군 C 소재 피해자 D(여, 13세, 이하 ‘피해자’라고만 한다)의 고모 E의 집 부근 노상에 세워둔 피고인의 F SM3 승용차 안에서, 피해자에게 “좋아한다, 한번만 자 달라.”라며 위 승용차 조수석에 앉아 있는 피해자의 허벅지 위에 앉아 피해자를 움직이지 못하게 하고 피해자가 “싫다.”라고 소리치며 저항하였음에도 불구하고 힘으로 피해자를 눌러 피해자의 반항을 억압한 다음, 피해자의 상의를 올려 가슴을 만지며 조수석 의자를 뒤로 밀고 피해자의 바지와 팬티를 벗기고, 계속하여 피해자의 앞쪽에 무릎을 꿇은 채 혀로 피해자의 성기를 핥고 다시 피해자의 몸 위로 올라타 피고인의 성기를 피해자의 음부에 삽입하여 청소년인 피해자를 강간하였다.

B. On August 20, 2010, at around 20:00, the Defendant: (a) stated that the Defendant was placed in the vicinity of the mountain path located in Yong-gun, Chungcheongnam-gun, Chungcheongnam-gun, the Defendant: (b) obstructed the victim’s sexual organ located in the Defendant’s FM3 car, “I will kill the victim, by damaging the vehicle inside the city.” (c) and the victim’s resistance to the Defendant’s intimidation, who was frightened by the Defendant’s intimidation; (d) obstructed the victim’s sexual organ back to the victim’s body; (e) obstructed the victim’s sexual organ back to the victim’s body; and (e) obstructed the victim’s sexual organ by inserting the victim’s inner organ into the negative part of the victim.

2. On February 21, 2013, around 00:30 on February 21, 2013, the Defendant posted his/her hand to the inside of the victim’s lower side while gathering his/her fingers from the Defendant’s gathering scheme located in Yong-gun G in Chungcheongnam-gun, Chungcheongnam-do.

Accordingly, the victim is to be inside and outside of the chest with two grandchildren.
