A defendant shall be punished by imprisonment for six years.

The defendant shall be ordered to complete the sexual assault treatment program for 80 hours.

Punishment of the crime

The defendant is a father of the victim C (here, 15 years of age) who is a relative with the victim.

1. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes;

A. On November 201, 2013, the Defendant committed a crime: (a) around 02:00 on the date of November 201, 2013, at the home of the Defendant in Seongbuk-gu Seoul apartment, the Defendant committed an indecent act by forcing the victim by promptly inserting the victim’s sound, inserting away from the victim’s panty and panty, and inserting the victim into the victim’s body.

2. 아동ㆍ청소년의성보호에관한법률위반(위계등간음) 피고인은 2014. 3. 일자불상경 위 아파트 안방에서, 피해자(당시 14세)와 함께 TV를 보다가 갑자기 피해자를 껴안으며 가슴을 만지고, 싫다며 몸부림치는 피해자에게 ‘재밌게 해준다. 아빠가 한번만 넣자’라며 피해자의 바지와 팬티를 벗긴 다음 입으로 피해자의 음부를 빨고 피고인의 성기를 피해자의 음부에 집어넣어 1회 간음하여 위력으로써 청소년인 피해자를 간음하였다.
