Punishment of the crime

On May 31, 2017, the Defendant was sentenced to imprisonment for one year and ten months for fraud at the Gwangju District Court on July 31, 2018.

(Criminal Facts)

1. The Defendant, on January 2019, 201, took part in the victim B (a person who is named, female, and 32 years of age) as his/her volunteer, and her 1,90,000 won or more for a month income to operate a singinging room with the premium of KRW 2,90,000,00 and run a siren business, and her singke business, had a large number of real estate properties, such as a house with the market price of KRW 60,00,00,000, or more than KRW 700,000,000.

However, in fact, the Defendant did not have any fixed income without a certain occupation, and there was no money in his own name or under water, and there was no other way to repay interest other than the principal borrowed, and thus, there was no intention or ability to repay the money as promised, even if he borrowed money from the victim.

그럼에도 피고인은 2019. 1. 23. 광주 서구 C 호텔 D호에서 피해자에게 “내가 불법 인터넷 도박사이트를 운용할 아이디를 샀는데 투자한 사람이 갑자기 돈을 토해내라고 하니 그 돈을 물어줘야 한다. 돈을 빌려주면 일주일 안에 사무실 보증금을 빼서 갚아주겠다.”고 거짓말을 하였다.

The Defendant received KRW 10 million from the victim as the borrowed money on the same day from the victim and received KRW 16.5 million in total from the victim to the E Union account (Account NumberF) in the name of the Defendant, and from February 23, 2019 to February 23, 2019.

Accordingly, the defendant was given property by deceiving the victim.
