A defendant shall be punished by imprisonment for not more than ten months.

5,000,000 won shall be additionally collected from the defendant.

The amount equivalent to the above additional charges.

Punishment of the crime

[2015 Highest 1355] The Defendant was a person without a certain occupation, and the fact is not a public official known to the Daejeon District Office of Education, and there is no intention or ability to employ victims' children as private school faculty members by soliciting them. Notwithstanding the fact, the victims C’ children were unable to be employed after graduating from the college of education in 2006, and the victim’s mind was unlikely to be employed after taking advantage of the fact that the victim C’s children did not have such influence on the Defendant, and they were able to receive money from the victims.

Accordingly, at around 15:00 on June 17, 201, the Defendant issued two copies of the cashier’s checks of KRW 10,000,000 on the same place from the victim, on the following grounds: “E” at the Jongno-gu Seoul Metropolitan Office of Education, the Defendant asked the son working at the Daejeon Office of Education to employ the son as a private school staff. It is possible to appoint the son by two semesters. On the other hand, it is necessary to appoint 20,000,000 in terms of expenses.”

Around December 15, 2011, the Defendant continued to post a telephone to the above victim and sent KRW 5,000,000 to the President of Daejeon District Office of Education and the President of a private school, who received KRW 5,00,000 from the victim’s new bank account under the name of the Defendant.

On June 6, 2013, the Defendant continued to post a telephone to the above victim and, on the other hand, was issued one cashier’s check of KRW 15,00,000 at a coffee shop in the G University located in Seo-gu, Seo-gu, Seo-gu, Seo-gu, Chungcheongnam-gu, and was issued by the victim at around 8th of the same month.

As such, the Defendant, as seen above, acquired 40,000,000 won by deceiving the victim, and handled by public officials at the same time.
