Defendant

Reasons
Punishment of the crime
【Defendant A, on January 9, 2018, was sentenced to one year of suspension of execution in six months of imprisonment with labor due to interference with the exercise of rights in the Busan District Court’s branch branch office, and the judgment became final and conclusive on January 17, 2018.
[Criminal Facts]
1. On September 2015, Defendant A’s joint crime committed by the Defendants: (a) was difficult to obtain additional loans to the extent that the sales of Defendant A, a stock company running by Defendant A, are reduced, and the repayment period of bank loans up to KRW 1.5 billion is extended; and (b) it was impossible to obtain additional loans for the management of the said company; (c) Defendant A entered into a so-called “the so-called “the white lease” contract, which was concluded with Defendant B, a seller of the instant small and medium-sized machinery, under which Defendant A was already used, as if the purchase price was newly purchased; and (d) when the purchase price was deposited from the leased company, Defendant A returned the said loan to Defendant A, and intended to use it as funds for the management of the company.
Accordingly, around October 22, 2015, Defendant B entered into a written estimate to sell 100 million won of the above machine learning center (VM960) owned by Defendant B to Defendant C, which is operated by Defendant B, at the office operated by Defendant B in Busan, and issued it to Defendant A. Defendant A using the said written estimate, etc., and Defendant A entered into a contract for the lease of facilities with Defendant A (the lease of facilities) for the lease of KRW 2,53,750 each month between 36 months and 36 months between 36 months and 36 months between 36 months when Defendant B used the above machine from Busan Gangseo-gu Busan corporation to pay 80,000,000 won after deducting 20,000 won of the deposit to Defendant B.
