Defendant

All appeals filed against A and B and the Defendant A and C of the Prosecutor are dismissed.

1. Summary of grounds for appeal;

A. Each sentence sentenced by the lower court to Defendant A and B (Defendant A: imprisonment of one and half years, confiscation and additional collection, Defendant B: imprisonment of one year and six months, and imprisonment of two years of suspended execution, confiscation and additional collection) is deemed to be too unreasonable.

B. Each sentence (for the defendant C: imprisonment with prison labor for one year, two years of suspended execution, confiscation, and additional collection) sentenced by the court below to the defendant A and C is deemed to be too uneasible and unfair.

2. It is recognized that the Defendants made confession of all of the instant crimes and reflect their mistakes in depth, all of the Defendants did not have any record of criminal punishment for the same crime, and Defendant C did not have any record of criminal punishment heavier than the suspended sentence.

However, the crime of this case is committed in collusion with Defendant A and C by purchasing 141 points in the aggregate of 2,35,981,050 won at a domestic duty-free shop in total at 71 times, and then re-taking them into the Republic of Korea without filing a customs declaration. Defendant A and B conspired with Defendant A and B to import 480 points in miscellaneous 379,810,830 won in total over 123 times in the above manner, including new shoes, etc., the market price of which is equivalent to 8,737,862,60 won in total, and 2,487 and 242 times in total, and then imported 1,277 points in light of the fact that the market price of this case was 1,277 points in miscellaneous, such as a new violation of the Customs Act, and that it is deemed that the new violation of the Customs Act and the Fair Trade Act, which would be considerable to 15,1960 won in total, without filing a customs declaration.
