1. On June 12, 2017, the Defendant issued a disposition to recover KRW 90,00,000 for the project cost against the Plaintiff-B University Industry-Academic Cooperation Foundation.

Details of the disposition

The Evaluation and Planning Institute for Food and Agriculture Technology (hereinafter referred to as the "Evaluation and Planning Institute") is an institution established pursuant to Article 8 of the Act on the Promotion of Science and Technology for Food and Agriculture to efficiently support the planning, management and evaluation of research and development projects to foster science and technology for agriculture, forestry and food, and the Director of Evaluation and Planning Institute

On December 18, 2015, the president of the Evaluation Institute and the president of the Industry-Academic Cooperation Foundation for B universities (hereinafter “instant task”) concluded an agreement on the research and development period from December 18, 2015 to December 17, 2017, and government-invested research and development expenses (hereinafter “project expenses”) during the first year (from December 18, 2015 to December 17, 2016) and the second year (from December 18, 2016 to December 17, 2017) respectively with KRW 90,00,000 (in total, KRW 30,000,000,000 each of the private charges and KRW 12,20,000,000,000) as the professor at B University (hereinafter “instant agreement”). The Plaintiff was selected as the professor at B University.

The Director of the Evaluation Institute paid KRW 90 million for the first year project cost to the Plaintiff B University Industry-Academic Cooperation Foundation (hereinafter “Plaintiff Industry-Academic Cooperation Foundation”). The Plaintiff A transferred the said KRW 90 million from the Plaintiff Industry-Academic Cooperation Foundation and performed research and development for the first year of the instant task.

On November 15, 2016, the Plaintiffs submitted the first year report (the annual and performance plan) to the Defendant and the Director of the Evaluation Institute. The Plaintiffs, as a result of the interim written evaluation, were evaluated as “unsatisfy”, and filed an objection against this, were subject to the re-angucing interim evaluation at the Evaluation Institute on December 13, 2016, and the results were also evaluated as “unsatisfy”.

On December 16, 2016, the Director of the Evaluation Institute notifies the Plaintiff Industry-Academic Cooperation Foundation of the suspension of research and development of the instant task on the ground that the results of the interim evaluation are insufficient, and the Director shall recover the project cost of KRW 90 million from the Plaintiff Industry-Academic Cooperation Foundation on March 28, 2017, and conduct national research and development projects for one year against the Plaintiff A.
