1. The part of the judgment of the first instance against the plaintiff shall be revoked.
2. The defendant shall pay to the plaintiff KRW 32,685,731 and 15,578 among them.
Reasons
1. In the first instance court, the Plaintiff claimed payment of KRW 10,708,775 (10,708,775 (2), 9,170,461 (2), 10,890,843 (4), 552,528 (5), and 7,071,89 (7,899) of the principal and interest of loan that the Defendant received from Hyundai Capital Corporation, and KRW 9,170,461 (3), and KRW 10,89 (10,843) of the principal and interest of loan that the Defendant received from Extraordinary Capital Corporation, and KRW 5,52,528 (5), and KRW 7,899 (7,071,89) of the principal and interest of loan that the Defendant received from
Since only the plaintiff appealed against this, the subject of the judgment of this court is the part of the claim for the principal and interest of the case that the plaintiff acquired from the Svia Savings Bank, the Gafa Capital Corporation, the Gafa Loan Corporation, and the Gafa Bank Co., Ltd. (hereinafter “the acquisition amount of the case”).
2. Determination on the claim for the transfer money of this case
A. On December 5, 2008, SB Savings Bank loaned 6 million won to the Defendant on December 5, 2008. As of January 8, 2014, the debt amount of the above loan reached 9,170,461 won in total (the principal amount of KRW 5,941,210 in interest of KRW 3,229,151 in interest of KRW 5,941,210 in interest of KRW 3,229,151 in interest of KRW). The SB Savings Bank transferred the above loan claim to the Plaintiff on December 10, 2010. 2) On March 29, 2008, SBB Love loaned 2 million to the Defendant. As of January 8, 2014, the debt amount reached the total of KRW 5,142,492 in interest of KRW 1,836,300 in interest of KRW 326,126).
On September 30, 2010, the Love Co., Ltd. transferred the claim for the above loan to the Boston Capital Co., Ltd., and notified the Defendant of the transfer of the claim on October 14, 2010. On June 21, 2013, the Love Co., Ltd. transferred the above claim for the loan to the Plaintiff.
3 The social company E&P created on October 14, 2008 shall be 2 million won to the defendant on October 14, 2008.
