1. 피고인은 2019. 8. 15. 08:15경 부산 사하구 B빌딩 앞에서 직전에 C노래방에서 지인을 통해 처음 알게 된 피해자 D(24세)에게 특별한 이유 없이 "야이 시발놈들아, 싸움 잘하나 개새끼야, 조용히 찌그러져 있어라, 좃같은 새끼들아"라며 욕설을 하였고 이에 피해자도 같이 욕설을 하자, 이에 격분하여 근처에 있는 'E' 음식점 주방에 있던 위험한 물건인 식칼(총길이 37cm, 칼날 25cm)을 들고 나와 피해자를 향해 찌를 듯이 다가가 피해자를 위협하였다.
