1. The Plaintiff:
A. The Defendant ABD Co., Ltd.: KRW 179,814,515 and its related thereto.
Reasons
1. Facts of recognition;
A. The Plaintiff is a company that distributes the digital consular system, and the Defendant Epis Co., Ltd. is a company that operates film tubes and conducts film business, etc., and the Plaintiff owned 607 of the building B and 4 lots of land outside Bupyeong-gu, Incheon (hereinafter “instant building”).
B. On November 21, 2013, the Plaintiff entered into a contract for the use of the digital cinema system (hereinafter “instant use contract”) with the Defendant Ampis Co., Ltd. under which the Plaintiff set up six sets of “digital Empis system” used for the screening of film, etc. to the Defendant Ampis Co., Ltd. as KRW 1.5 million per set of the installation cost per set of KRW 1.5 million and the usage fee of KRW 20 million. On January 21, 2014, the Plaintiff established six sets of the Empis system in the digital building of this case.
The relevant terms and conditions of the instant contract are as follows.
Defendant A, Inc. (hereinafter “A”) and the Plaintiff (hereinafter “B”) enter into a contract with respect to the use of the digital cinema system on November 21, 2013 as follows.
Article 2 (Definitions of Terms) (1) The following terms used in this Agreement shall mean the following terms, and the short term shall be interpreted as the context requires:
1. Digital contents: referring to the contents shown by using the digital cinema system, and their specific subjects shall be prescribed in paragraph (2) of this Article;
2. Digital cinema system; a system used to show digital contents in the theater; a digital protocol projector; a digital media server; and an annex equipment necessary for digital screening in the theater;
3. Digital protocol projector; digital protocol projector; referring to a digital protocol projector owned and used by A under this Agreement for the purpose of meeting DCI SPEC 1.2 and for use in the theater for digital content screening.
