피고인들 및 G, H, I은 J, K 등과 2012. 11. 1. 01:00경부터 06:30경까지 용인시 처인구 L에 있는 M펜션 바다동에서 화투 등 도박에 필요한 시설 등을 갖추고 음식물 등을 제공하면서 N 등 수십명의 도박참가자들을 불러들인 다음, 화투패 20장을 이용하여 도리짓고땡 방식으로 게임을 진행하면서 도박참가자들로 하여금 각자 바닥에 깔린 패에 돈을 걸도록 하고 그 패와 도박주재자인 속칭 ‘총잡이’가 가진 패와 비교하여 끝자리 숫자가 높은 쪽이 이기는 방법으로 도박을 하도록 하고, 그 대가로 도박참가자로부터 매회 판돈의 5~10%의 일정 비율에 해당하는 금액을 떼어 불상의 이익을 취하는 방법으로 도박개장을 하는 등 2012. 11. 1.경부터 2012. 11. 12.경 공소장 기재 2012. 1. 12.경은 2012. 11. 12.경의 명백한 오기로 보인다.
