A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

[2019 order483] No person shall intermediate a third party's communications or provide it for a third party's communications using telecommunications services provided by a telecommunications business operator.

On January 1, 2019, the Defendant received a proposal from an unexplic person who became aware of while searching for loans at the Internet site, and received the proposal from the unexplic person that “to provide 5,000 won per 1 mobile phone number in each week by opening the phone number,” and on January 14, 2019, the Defendant established a corporation whose name of the corporation is “B” and “A”, etc.

1. On January 22, 2019, the Defendant: (a) opened the Internet phone in the name of the non-party B, which was a telecommunications business operator, with the following: (b) confirmed the fact that the non-party B filed an application for opening the Internet phone in the name of the telecommunications business operator C070; and (c) provided that the non-party B, as indicated in [Attachment] Nos. 1 to 50 telephone numbers, can be changed to one representative number (02 country number) per five telephone numbers (02 country number) as indicated in [Attachment] Nos. 1 to 50; and (d) provided that the non-party B may use the above Internet phone in the name of the telecommunications business operator.

Accordingly, the defendant provided telecommunications services provided by telecommunications business operators for another's communications.

2. Around March 5, 2019, the Defendant: (a) drafted a written contract for application for 100 digital telephone (delivery) in the name of the limited liability company B in the name of the limited liability company B in the name of the mobile telecommunications business operator D Co., Ltd.; and (b) sent it to the above in facsimile by facsimile; (c) had the above infax open 10 digital telephone numbers (02 national telephone numbers) as indicated in [Attachment] Nos. 51 through 150, such as “G”, etc.; and (d) provided that the above influence phone numbers (02 national telephone numbers) to the above influence.
