Reasons
Punishment of the crime
[Basic Facts] Since April 2015, G established and substantially operated H and 101 Dong 219 from Incheon Gyeyang-gu, Incheon, and 101 Dong 219. On March 2016, G moved the above office to the J and 2nd floor in Bupyeong-gu, Incheon, and continued to change its trade name to K. On January 2017, G established L at the same place and operated it together.
Defendant
A served as the general manager of the said I and K from April 2015 to October 2017; Defendant B from November 2015 to October 2017; Defendant C was the employee in charge of the said I and K’s business; Defendant C was the employee in charge of the business from July 2016 to July 2017; and M and N were the employees in charge of the said K from October 2015 to September 2016, respectively.
G is a person eligible for the “employment promotion subsidy” if the unemployed in the disadvantaged group has completed the first stage employment consultation program of the “employment successful height support program” operated by the Ministry of Labor. As above, the business owner who newly employs a new employee who has completed the first stage of the “employment successful failure support program” shall provide the “employment promotion subsidy” program for a maximum of 9,000,000 won per year between the injured Korean Ministry of Labor and Labor in order to alleviate the management burden, and shall contact with the I, K, and Internet job offer website operated by himself/herself, and shall provide them with contact with the K and the “business head management consultation program” after having completed the first stage of the “employment successful height support program,” but after having completed the first stage of the “employment successful employment failure” support program, he/she shall obtain the falsely prepared employment promotion support application form, etc., and shall provide them with information on the operation and food of the A, and shall provide them to the Ministry of Labor, and shall provide them with information on the general operation and food of the A, the details of the G’s employment promotion program.
