1. The punishment of the accused shall be one year;
2. Provided, That the above punishment shall be imposed for a period of two years from the date this judgment becomes final;
Reasons
Punishment of the crime
1. The Defendant, in violation of the Act on the Regulation of Similar Receiving Acts related to C, is the head of the Dong-dong Center, Seoul Special Metropolitan City, Busan Special Metropolitan City, 508, which held an investment presentation and has played the role of soliciting investors.
No one shall agree to pay the full amount of contributions or an amount in excess thereof in the future without obtaining authorization or permission from the authorities and shall receive similar money, etc. from many and unspecified persons for the purpose of making investments, etc.
Nevertheless, on March 17, 2014, the Defendant agreed to the following: “I shall pay 1% of the principal of the investment every day as dividends if I make an investment in the business of operating a restaurant directly operated by the inside and outside of the Republic of Korea with the knowledge of the authority and the delivery of the principal to the restaurant,” and then I shall receive 50,000 won in cash on the same day from E and receive 5,50,000 won in cash from E, and then I shall receive 3,300,000 won in the name of the Agricultural Bank account (number 30,38541) in the name of F on the telephone around April 10, 2014 (number 30,0145541) and then receive 3,30,000 won in the above account from H around 230,204 to H on April 23, 2014, and received 606,000 won in the above account, respectively.
As a result, the Defendant agreed to pay the total amount of the investment or the amount exceeding it in the future without obtaining authorization or permission from the authorities, and imported a similar receipt of the investment amounting to KRW 132 million.
2. The Defendant is the representative of KJ in Dong-dong-si, K in violation of the Act on the Regulation of Similar Receiving Act related to J-related K.
Any person shall pay the full amount of contributions or the amount in excess thereof in the future without obtaining authorization or permission from the authorities.
