Defendant

A shall be punished by a fine for negligence of KRW 8,000,000, and by a fine of KRW 8,000,000.

The above fine is imposed against the Defendants.

Punishment of the crime

1. 2014. 5. 15.자 범행 피고인들은 E과 공동하여, 2014. 5. 15. 20:00경부터 같은날 24:00경까지 경북 울진군 F에 있는 ‘G’ 내실에서, 피해자 H(49세), 피해자 I(43세)과 함께 화투 20매를 가지고 5장씩 4패로 나누어 각 5장 중 3장의 합을 10이나, 20으로 맞추고 나서 나머지 남은 2장의 합계 중에서 끝자리수가 높은 사람이 승리하는 속칭 ‘도리짓고땡’이라는 화투도박을 하면서 피고인 B은 위 E으로부터 건네받은 장비를 몸에 두르고, 비밀표시가 된 목화투를 이용하여 피해자들에게 배부되는 화투패의 숫자를 모두 알아낸 후 함께 도박을 하고 있던 피고인 A에게 손짓으로 이를 알려주는 방법으로 사기도박을 하여 피해자들을 기망하고, 이에 속은 피해자들로부터 금원을 편취하려고 하였으나 피고인 B이 착용하고 있던 장비들이 정상적으로 작동하지 않는 바람에 그 뜻을 이루지 못하고 미수에 그쳤다.
