Purport of claim and appeal

The fact that there is no dispute over the cause of the claim, the entry of Gap evidence No. 1, and the purport of the entire pleadings, the plaintiff is a company engaged in the wholesale and retail business, etc., and the plaintiff and the defendant are engaged in the electrical construction business, etc., and the plaintiff and the defendant have paid the price by cash or account transfer immediately after the plaintiff supplied the goods to the defendant from November 28, 2014 to January 30, 2015. The plaintiff supplied the lighting organization equivalent to the sum of 21,619,400 won to the defendant from November 28, 2014 to January 30, 2015. The plaintiff received from the defendant the sum of KRW 12,00,000 among the above goods (= KRW 4,000,000,000 from September 25, 2015).

According to the above facts, the defendant is obligated to pay to the plaintiff the remainder amount of KRW 9,619,400 (=21,619,400 - 12,000,000) and damages for delay, unless there are special circumstances.

2. Determination on set-off defense against the defendant's damage claim against the plaintiff against the plaintiff

가. 피고 주장의 요지 원고가 납품한 조명기구 중 ‘C성당’에 설치한 30개 및 ‘D교회’에 설치한 94개에서 깜빡거리는 현상이 발생하여 이를 보수하기 위하여 위 조명기구를 교체하여야 한다.
