A defendant shall be punished by imprisonment for not less than eight months.

Costs of lawsuit shall be borne by the defendant.

Punishment of the crime

From November 2013 to December 4, 2015, the Defendant was in office as the representative director of the business part of the lighting organization manufacturing and selling company of the victim E company, and has overall control over the sales and management of lighting organization of the victim company E company, and there was a duty to manage the customer of the victim company for the victim company, and to supply the lighting organization to the trading office in accordance with the supply contract so that the sales profit belongs to the victim company.

On the other hand, F, the Defendant’s spouse, was not engaged in the production and distribution of lighting fixtures, but established G, the Do retail company of lighting fixtures around July 13, 2015, which was an employee, only H, who was an employee. On November 19, 2015, the Defendant established I for the purpose of manufacturing and selling lighting fixtures and others.

Defendant 1: (a) in violation of the aforementioned occupational duties and continuously maintained transaction relations with the victim company on July 2015, 2015, in inducing the above G to enter into a supply contract of KRW 259,235,570 with respect to the supply of lighting fixtures of the JK apartment construction in Yanancheon-gu by inducing the said G to enter into a supply contract of KRW 259,235,570 on the supply of lighting fixtures; (b) thereby having the said G to obtain pecuniary benefits equivalent to the amount of sales; and (c) thereby causing the victims to obtain pecuniary losses equivalent to the amount of sales; and (d) as indicated in the list of crimes in the attached Table of Crimes from the Hanman to November 2015, 2015, the said JJ corporation or the Defendant supplied lighting fixtures to the victim company through the business as the representative director of the victim company; and (d) had the LI corporation or the said G corporation to enter into a supply contract of KRW 630,2465,700.
