Defendants shall be punished by imprisonment for ten months.
However, with respect to Defendant B, it shall be for 2 years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
No person shall, in using and managing the means of access to electronic financial transactions, borrow or lend a means of access or keep, deliver or distribute the means of access with the knowledge that such means are to be used for a crime or to be used for a crime.
Nevertheless, the Defendants knew that the solicitors of passbooks are soliciting passbooks, cash cards, etc. from many unspecified persons in order to use them for crime or illegal purposes, and they also posted small loans advertisements on their own Internet site to report them and recruited cash cards, etc. in the account from those who directly reported and contacted them, and offered to lend them again to the solicitors of the passbooks.
1. The Defendants committed the crime of February 13, 2015, around 09:00 on February 13, 2015, received one passbook in the name of the bank account (Account Number:F) and two cash cards from the E that reported and contacted the said advertisement in the street near the subway 8 Station located in the Gangdong-gu Seoul Metropolitan Government Cancer Group.
At around 11:00 on the same day, the Defendants continued to transmit one passbook to the account in the name-free person who became aware of the fact through Kakakao Stockholm on the street near the H convenience store in Gwangjin-gu Seoul Special Metropolitan City through Kwikset Service and one cash card.
Ultimately, the Defendants conspired to borrow and lend the means of access as above.
2. On February 23, 2015, around 11:00 on February 23, 2015, Defendants: (a) received one passbook of the company bank account (Account Number:J) and two cash cards from the I who reported and contacted the said advertisement in the street near the subway 5 Station located in Songpa-gu Seoul Metropolitan Area, Songpa-gu, Seoul; (b) around February 23, 2015.
At that time, the Defendants continued to transmit one passbook to the account holder in the name-based bank account and one cash card to the account holder who became aware of through Kwikset service.
Ultimately, the Defendants conspired to share the means of access as above.
