The judgment of the court below is reversed.

A defendant shall be punished by imprisonment for up to seven months.

1. The sentence imposed by the lower court (four months of imprisonment) on the summary of the grounds for appeal is too unfased and unreasonable.

2. It is recognized that there is no past record of the judgment of the defendant who was sentenced to a fine heavier than a fine, and there is no past record of criminal punishment after being sentenced to a fine of 2 million won due to a crime of violating the Road Traffic Act in around 2004.

그러나 이 사건 각 범행의 태양 및 수법 등에 비추어 그 죄질이 몹시 나쁠 뿐만 아니라, 이 사건 각 공무집행 방해 범행은 피고인이 공무를 집행하는 경찰관 4명을 폭행하여 공무집행을 방해한 것으로 최근의 공권력 경시 풍조를 고려할 때 엄히 처벌할 필요가 있는 점, 업무 방해의 정도가 중한 점, 피고인은 폭력범죄로 벌금형 3회 처벌 받은 전력이 있는 점, 피해자와 합의하지 못하였고 피해 경찰관들에게 서 용서 받지도 못한 점, 그 밖에 피고인의 나이, 성 행, 환경, 이 사건 각 범행의 동기, 수단과 결과, 범행 후의 정황 등 이 사건 변론에 나타난 모든 양형 조건과 대법원 양형 위원회 제정 양형기준의 권고 형량 범위를 참작하면, 원심의 형은 너무 가벼워서 부당 하다고 인정된다.

3. Accordingly, the prosecutor’s appeal is with merit, and the judgment of the court below is reversed pursuant to Article 364(6) of the Criminal Procedure Act, and it is again decided after pleading as follows.

The summary of the facts charged and the summary of the evidence recognized by the court is identical to the facts stated in the corresponding column of the judgment below, and thus, the summary of the evidence is cited in accordance with Article 369 of the Criminal Procedure Act.

1. Articles 40 and 50 of the Commercial Concurrent Crimes Act (the punishment stipulated by the crime of obstructing the performance of official duties by mutual consent and by obstructing the performance of official duties by police officers F with the largest criminal situation).
