Punishment of the crime

1. The Defendants, at around 22:50 on August 22, 2014, were required to pay the alcohol value and return home from police slope G and the Inspector H belonging to the Jeju East Police Station, who was called by the Defendants, upon receiving a report from the “F” entertainment tavern for the operation of E in Jeju Island, and having failed to calculate the alcohol value.

그러자 피고인 A은 G에게 ‘너가 뭔데 술값을 계산하라고 하느냐, 이 호로새끼야’라고 욕설을 하면서 손날을 세워 손끝으로 G의 복부를 수회 찌르고 왼손으로 G의 팔을 잡고 위 주점 내의 룸으로 끌고 가 주먹으로 때릴 듯이 시늉을 하고, 이에 H이 자신을 현행범으로 체포하려 하자, H의 얼굴을 주먹으로 1회 때리고, 피고인 B은 경찰관들에게 “이 개새끼야, 너가 뭔데 지랄이냐”라고 하면서 피고인 A을 체포하려는 H의 근무복 조끼를 잡아당기고 G의 머리를 손으로 잡아당기는 등 폭행함으로써, 피고인들은 공모하여 경찰공무원의 112신고사건 처리업무에 관한 정당한 직무집행을 방해하였다.

2. 피고인 A의 모욕 피고인은 2014. 8. 22. 23:55경 제주시 I에 있는 제주동부경찰서 J지구대 사무실에서, 제1항 기재와 같은 이유로 현행범체포를 당한 것에 불만을 품고, 위 E 및 다른 경찰관들이 있는 가운데 경찰관인 피해자 순경 K(여, 26세)에게 “개지랄하네, 멍청한 것들이 9급 공무원이나 하면서 짭새 소리를 듣는다”, “이러니깐 깡패나 경찰이나 똑같다, 씨발년아”라고 욕설하여 공연히 피해자를 모욕하였다.
