A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

1. 공용물건손상 피고인은 2016. 9. 1. 22:00경 부산 남구 B 소재 ‘C’ 식당 앞 노상에서, 술에 취한 사람이 소란을 피운다는 112신고를 받고 현장에 출동한 부산남부경찰서 D지구대 소속 경위 E과 이야기를 하던 중, 아무런 이유 없이 위 경찰관에게 “야 씹할 놈아 내가 뭘 그리 잘못한 게 있노”라며 욕설을 하면서 112순찰 차량(F) 좌측 후렌다 부위를 발로 1회 차 찌그려 뜨려 공무소에서 사용 중인 공용물건인 위 순찰차를 수리비 386,670원 상당이 들도록 손괴하였다.

2. The Defendant committed an act of obstruction of performance of official duties at the time, place, and the circumstance E’s attempt to arrest the Defendant in the act of committing an offense under the charge of damaging public goods, and committed an assault on three occasions with the chest of the said police officer as his hand.

Accordingly, the defendant interfered with legitimate performance of official duties concerning crime prevention, suppression, arrest and investigation by police officers.
