1. Defendant cases Co., Ltd.: KRW 51,407,048 and its related amount from June 1, 2012 to May 28, 2015 to the Plaintiff.
Reasons
1. Basic facts
A. The Plaintiff’s claim against the Defendant E-ray Co., Ltd. was a company selling steel products, etc., and processed H-be from the Defendant E-ray Co., Ltd. (hereinafter “Defendant E-ray”) and supplied it to the Defendant E-ray again. The Defendant E-ray’s claim against the processing cost amounted to KRW 51,407,048.
B. Claim 1 against Defendant Dack Korea Co., Ltd. (hereinafter “Korea”) is the case case Korea Co., Ltd. (hereinafter “Korea”).
2) On October 2010, 2010, Japan Building Co., Ltd. (hereinafter “D building site”) awarded a contract for the construction of steel frame among the new construction of “D building” located in east east east east east east east east east east.
(2) On November 29, 2010, 2010, Eththical Co., Ltd., Ltd. (hereinafter referred to as “tethethyl”) subcontracted the production and supply of steel framed BH in relation to the said construction, and ethyl was sub-subcontracted on June 7, 201 by setting the contract amount of 242,00,000, in part of the said construction to Defendant Ethical license.
3) After doing so, the Defendant instant case settled the construction cost of the ethyl and the sub-subcontract at KRW 580,654,967, and the construction cost of the said sub-subcontract remains at KRW 228,00,000 due to the partial repayment of the construction cost from ethyl. On August 8, 2011, the Plaintiff declared that the ethyl would be unable to pay the construction cost any longer due to the aggravation of business management; 4) and B and C of this case on October 14, 2011. The Defendant instant case drafted a letter to the effect that “The payment of the construction cost of KRW 228,00,000,000, which was unpaid, will be jointly and severally repaid.”
5) On October 14, 201, Defendant E-ray received KRW 10,00,000 out of the above construction cost from B, and on February 1, 2012, the remainder of the construction cost paid KRW 37,292,239 out of the above construction cost was KRW 180,707,761 (i.e., KRW 228,000,000 - KRW 10,000,000 - KRW 37,292,239.
