[Defendant A] The defendant shall be punished by imprisonment for two years.
However, the above sentence shall be executed for a period of three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Defendant A is a person who actually operated “J Co., Ltd.” and “K” that sell fruitp, etc. in Busan Young-gu I.
A. The Defendant supplied marine construction companies with construction fruits, while washing them with chemical drugs used at another construction site, and removed oil, using the fact that it is difficult to distinguish them from the shore, with respect to the removal of the oil, and after washing heavy fruit, it was supplied as if it were a new product or as if it were a new product or as if it were a domestic product.
On February 11, 2015, the Defendant supplied 175 high-speed fishing (32m, length 3.5m) to the victims of this Fisheries Development Co., Ltd. (hereinafter “J”) who clean up the middle and high-speed fishing as chemical medicine, and perform construction works near the port of Pyeongtaek-si as new products, as if they were new products, and received KRW 4,523,200 from the victims of this case on April 6, 2015.
In addition, the Defendant received 21,907,800 won from the victims on five occasions from June 27, 2014 to the above day, as stated in the List of Crimes (1).
B. Around July 23, 2014, the Defendant attempted to acquire the proceeds by supplying the marine construction business headquarters located in Jeju-do with 3rd Co., Ltd. as if he/she had been domestically produced approximately KRW 1,000 4,600,000 with China, but did not pay the proceeds. However, the Defendant failed to pay the proceeds.
