가. 피고인은 2018. 9. 30. 12:17경 청도군 B에 있는 C병원 응급실에서, 성명불상의 원무과 직원이 인적사항을 묻자 “씨발놈! 죽여버린다!”라고 큰소리로 욕설하고, 침상에 누운 채로 위 병원에서 근무하는 수간호사인 피해자 D에게 “씹할년아! 밥도! 야 이 가시나야!”라고 큰소리로 욕설하면서 소란을 피워 위력으로 약 1시간 동안 피해자의 응급실 진료업무를 방해하였다.
