Defendant shall be punished by a fine of 6 million won.
If the defendant fails to pay the above fine, one hundred thousand won shall be one day.
Reasons
Punishment of the crime
1. Around January 23, 2017, the Defendant committed the crime of January 23, 2017: (a) committed the act as if he would pay the amount in D’s “D” managed by the victim C located underground in Gangnam-gu Seoul Metropolitan Government B building; and (b) ordered the victim to drink, food, etc.
However, the defendant did not have any intent or ability to pay the price because he did not have any particular property at the time and did not have any means of settlement, such as cash and credit card, which can pay the price sufficiently.
Nevertheless, the Defendant, as above, by deceiving the victim, was provided with alcohol and entertainment services equivalent to KRW 1,428,00,00 in total, including two diseases with a total of KRW 110,000,000 in the market value, 30,000 in the market value, and 60,000 in the market value.
2. The Defendant committed the crime on January 30, 2017, committed the crime, around January 30, 2017, committed as if he would pay the price in D, and ordered the said victim to drink, food, etc.
However, the defendant did not have any intention or ability to pay the price for the same reason as the above 1.
Nevertheless, the Defendant, as above, by deceiving the victim, was provided with alcohol and entertainment services equivalent to KRW 1,680,000 in total, 200,000,000,000 in the market value of KRW 30,000,00,000,000.
3. Around February 4, 2017, the Defendant committed the crime on February 4, 2017, committed the act as if he would pay the price in D, and ordered the said victim to drink, food, etc.
However, the defendant did not have any intention or ability to pay the price for the same reason as the above 1.
Nevertheless, the Defendant, as seen above, by deceiving the victim, was provided with alcohol and entertainment services equivalent to KRW 1,400,000 in total, including 1,50,000,000,000,000,000 of the market price, and 30,000,000,000.
