Punishment of the crime
[2014 Highest 2370] On June 9, 2014, the Defendant ordered alcohol and service equivalent to KRW 410,000,00 in total, as if the Defendant would pay the amount to the victim’s 1st underground floor of Geumcheon-gu Seoul Metropolitan Government, at the “E danran bar” operated by the victim D, who was in the first underground floor of Geumcheon-gu Seoul Metropolitan Government C, and as if he would pay the amount to the victim, at the market price of KRW 390,00,000.
However, the defendant did not have an intention or ability to pay the amount because he did not have an interest rate at the time.
The defendant was provided with the 410,000 won in total from the victim and acquired the alcohol and service.
【2014 Highest 2490】
1. On June 14, 2014, at around 23:30, the Defendant issued an order to pay food, etc. even if he/she did not have an intent or ability to pay the price. However, as if he/she would pay the price to the victim H, the Defendant ordered food, etc. as if he/she would pay the price to the above restaurant operator, he/she received an order from the victim, namely, that he/she received an amount equivalent to KRW 20,000 in total from the victim, i.e., 20 beer, 20, and 770,000 in music service.
2. On June 23, 2014, the Defendant: (a) around 21:00, the fact at K Garan, located in the Gwanak-gu Seoul Special Metropolitan CityJ, did not have the intent or ability to pay the price even after ordering food, etc.; (b) ordered food, etc. as if he would pay the price to the victim L who is the principal restaurant; and (c) was provided by the victim with the sum of KRW 312,00 per share per two weeks and per two weeks per two weeks from the victim’s seat.
Accordingly, the defendant was provided property by deceiving the victims.
[2014 Highest 2749] On June 3, 2014, the Defendant: (a) around 02:42, at the main point of “O” operated by the victim N in Gangnam-gu Seoul Metropolitan Government M, the Defendant was provided with the two main points in which the sum of KRW 600,000 was 5 and 600,000 from the victim as if he did not have the intent or ability to pay the price, and received the payment from the victim.
