A defendant shall be punished by imprisonment for three years.

However, the execution of the above punishment shall be suspended for four years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a member of the management office of the Ma Apartment-gu, Daegubuk-gu, where the victim D (V, 28 years old) resides, and the victim is a disabled person of class 2 of intellectual disability.

The defendant knew that the victim was unable to make a reasonable resistance because of his falling off intelligence and lack of judgment ability to do so, and used it to have sexual assault against the victim.

1. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes;

A. On June 25, 2013, the Defendant visited the victim’s residence at the toilet repair issue requested by the victim at the victim’s residence, and became only the victim’s her son while repairing the change from the toilet in the victim’s residence.

Accordingly, the defendant committed indecent acts by compulsion against the victim with mental disability.

B. On 2013, the Defendant visited the victim’s residence at the time of the foregoing victim by sending a notice of management expenses to him/her, and entered the room where the victim was located and made the victim take the victim’s hand and knife the Defendant’s sexual organ on his/her hand.

Accordingly, the defendant committed indecent acts by compulsion against the victim with mental disability.

C. On January 201, 2014, the Defendant visited the victim’s residence in order to urge the payment of management expenses, and then reported that the body was accumulated in an open room by the victim’s body, and that the victim was accumulated in the clothes, and that the victim’s chests and fluences were stored in the part of the victim’s body.

Accordingly, the defendant committed indecent acts by compulsion against the victim with mental disability.

2. On February 20, 2014, the Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (rape-rape, etc. of Persons with Disabilities) visited the victim’s residence before giving notice of management expenses to the victim, and enters the victim’s room where the victim is located, and let the victim take her part in the beds “the victim she is said to be arbit in the beds”, and then put the victim’s her bar on the part of the victim’s her hand.
