A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Despite the fact that the Defendant is not a narcotics handler, the Defendant handled the Meteptopy (one philopon; hereinafter “philopon”) which is a local mental medicine as follows.
1. Purchasing philophones;
A. On July 29, 2017, the Defendant paid KRW 900,000 in cash to D as the price, and received approximately KRW 3g plasticphones from D, and purchased them.
B. On August 12, 2017, around 10:00, the Defendant dialogueed with the above D and the printing app “E”, and purchased approximately KRW 2.4 million in the total amount of philopon, which was divided into eight plastic packaging in the instant 1st floor boiler room in Gangseo-gu Seoul, Gangseo-gu, Seoul, a place where the Defendant was informed of the fact that the Defendant would pay 2.4 million won in the future, and that he/she purchased it by finding approximately 8g in the aggregate of philopon, which was contained in eight plastic packaging rooms in the instant 1st floor boiler room in Gangseo-gu, Seoul.
2. Sale of philophones;
A. At around 13:00 on July 29, 2017, the Defendant received KRW 600,000,000 in cash from I as the price and sold a vinyl package containing approximately 1g, written to him/her.
B. On August 5, 2017, at around 12:00, the Defendant received 600,000 won in cash from I within the pertinent radar car parked in the same place as above (1) and delivered one vinyl package to him/her, and sold it.
3. On August 12, 2017, the Defendant administered philophone medication by inserting approximately 0.03g of philophone into a single-use toilet in Nam-gu Incheon Metropolitan City, the first floor of “J shopping district” and 0.03g of philophone into a single-use injection machine, and melting it into the bloodline, and administering it in a way of injecting it into the arms.
4. Around 12:05 on August 12, 2017, the Defendant attempted to sell philophonephones in front of the “KT mobile phone agency” located in Yeongdeungpo-gu Seoul Metropolitan Government, and attempted to sell 1.8 million won of philophones 3gs in front of the “KT mobile phone agency” located in Yeongdeungpo-gu Seoul, Yeongdeungpo-gu, Seoul. However, the Defendant did not go through an attempted attempt to arrest the police officer who was divingd in advance.
5. Handphones;
