Reasons
Punishment of the crime
[2018 Highest 3549] (Defendant A) despite the fact that Defendant A is not a narcotics handler, Defendant A dealt with Metephographs (one philopon; hereinafter “philopon”) which are a local mental medicine as follows.
1. Purchasing philophones;
A. On May 12, 2018, Defendant A purchased KRW 900,000,000 from 12,000 to 3g of philopon, which was parked in the vicinity of E Station located in Suwon-si, at the price, to B with cash KRW 90,000,000 from 1,00 to 3g of philopon contained in vinyl packaging.
B. On May 19, 2018, Defendant A purchased the said car that was parked near E station No. 5 Station No. 1 as indicated in paragraph (1) around May 19, 2018, Defendant A purchased KRW 900,000 in cash to the said B at the price, and approximately 3g of the penphones contained in vinyl packaging from the said buyer.
2. On May 15, 2018, Defendant A sold approximately KRW 450,000 in cash from H in front of the dwelling area of Ansan-si G and 301,000 in consideration of the price and distributed approximately 1g of the penphone, which is divided into two vinyls.
