A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Around 20:40 on June 4, 2015, the Defendant insultd the victim by openly insulting the victim by saying, “I will see son, son, bitch son, bitch bitch son, bitch bitch son, etc., sent out after having reported 112 by avoiding the disturbance of street lamps, etc., under the influence of alcohol, and on the part of the police officers, approximately 10 people in the neighborhood.”

2. 공무집행방해 피고인은 같은 일시, 장소에서 위와 같이 112신고를 받고 출동한 서울중랑경찰서 E파출소 소속 경장 D으로부터 집으로 귀가하라는 권유를 받자, 왼손으로 위 D의 왼쪽 팔뚝 부위를 1회 꼬집고, 위 D에 의해 모욕죄 등으로 현행범인으로 체포되어 순찰차 우측 뒷좌석에 앉게 되자 오른발로 위 D의 가슴 부위를 1회 차고, 계속하여 순찰차를 타고 E파출소에 도착한 다음 대기석에 앉지 않고 난동을 피워 위 D이 피고인에게 수갑을 채우려고 하자 오른발로 위 D의 왼쪽 정강이를 1회 찼다.

Accordingly, the defendant interfered with legitimate execution of duties concerning the handling of 112 reports by the police officers and arrest of flagrant offenders.

A. The first type of the obstruction of performance of official duties (the scope of recommendations) shall be punished by imprisonment with prison labor for the basic area from 6 months to 1 year.
