A defendant shall be punished by imprisonment for not less than one year and six months.

5,218,00 won shall be additionally collected from the defendant.

The additional collection charge shall be equivalent to the above additional collection charge.

Punishment of the crime

Notwithstanding that the Defendant is not a person handling narcotics as a Chinese person, the Defendant handled the psychotropic drugs-related clocks (one philopon; hereinafter “philopon”) as follows:

1. Sale of philophones;

A. On October 11, 2017, at around 17:00, the Defendant sold phiphones by receiving KRW 3.50,00 from C, and 0.5g philophones, in the direction of building up approximately 0.5g of philophones.

B. On October 16, 2017, at around 21:02, the Defendant transferred KRW 3.50,000 from C to the Agricultural Cooperative (E) account in the name of the Defendant’s use, and on around 22:50 of the same day, sold opon to C in a way of drying approximately 0.5g of opon from the road side near Seocheon-gu, Seocheon-si, Seocheon-si, and selling opon to C.

C. At around 18:40 on October 27, 2017, the Defendant received KRW 300,000 from C to the Agricultural Cooperative account in the above name D used by the Defendant, and sold opphones to C in a way that 0.5g of opphones from the road surface near Seocheon-gu, Seocheon-si, Seocheon-si, Seoul, and around 21:35 on the same day.

around 18:10 on October 31, 2017, the Defendant received KRW 9.50,000 from C to the Agricultural Cooperative account in the above D name used by the Defendant, and sold 1.5g of Handphones to C at around the roads near Seocheon-gu, Seocheon-gu, Busan, and around 20:25 on the same day.

E. On November 11, 2017, the Defendant received KRW 180,000 from C to the Agricultural Cooperative account in the above name D used by the Defendant, and sold 0,000,000 from the roads near the Seocheon-gu, Seocheon-gu, Seocheon-si, and sold 0.25g of opphones to C in a way of drying about 0.25g of opphones.

F. On November 18, 2017, the Defendant received KRW 200,000 from C to the Agricultural Cooperative account in the above name D used by the Defendant, and sold 00,000,000 from the roads near the Seocheon-gu, Seocheon-si, Seocheon-si, and sold 0.25 g of opphones to C in a way of drying up approximately 0.25 g of opphones.
