1. All of the plaintiffs' claims are dismissed.

2. The costs of lawsuit are assessed against the plaintiffs.

1. Basic facts

A. On March 9, 2015, the deceased A (hereinafter “the deceased”) hospitalized in the G Hospital located in Seodaemun-gu Seoul, Seodaemun-gu, Seoul (hereinafter “Defendant Hospital”) for the treatment and recuperation of dementia symptoms.

B. On July 7, 2016, when the Defendant Hospital was hospitalized, the Deceased was at the first time in the Defendant Hospital, and thereafter, the state of his blood pressure was lowered and the oxygen was reduced to 96% on November 10, 2016. The deceased was transferred to the Medical Care Center located in Yangju-si by reflecting his intention in consultation with the Plaintiff.

C. On December 10, 2016, the deceased was transferred to the emergency room of H Hospital during his/her hospitalization at the Medical Center for Veterans Affairs, and the results of a close inspection were found to have been discovered in the Madern and elel, knee, knee, and sel.

On February 3, 2017, the Deceased was discharged from an infection and was treated for antibiotics treatment and bathing treatment. On February 27, 2017, the Deceased was transferred to the I Hospital.

At the time of the transfer of I Hospital, the Deceased was extremely difficult to lead a daily life without nursing care. The Deceased was hospitalized in the above hospital and died on December 7, 2019 on which the instant lawsuit was pending.

The plaintiffs are co-inheritors as children of the deceased.

2. Since the medical personnel at Defendant Hospital asserted by the Plaintiffs committed the following medical negligence in the treatment of the Deceased, resulting in the male of the Deceased’s failure to walk, the medical personnel at Defendant Hospital should compensate the Plaintiffs for the damages incurred therefrom.

The medical staff of the Defendant Hospital neglected the management of the Deceased, resulting in the brutation of the deceased, and did not provide any appropriate treatment thereafter.
