피고인은 피해자 R, 피해자 Q에게 “야 이. 씨 벌새끼야 뭘 쳐다봐 ”라고 욕설을 하면서 피해자 R의 멱살을 양손으로 잡아 밀어 넘어뜨리고, 피해자 Q의 얼굴을 양손으로 수차례 가격하고, 옆에 있는 M은 이에 가세하여 피해자 Q의 멱살을 양손으로 잡고 피해자 Q의 머리를 자신의 머리로 들이받고, 얼굴을 양 주먹과 발로 수차례 가격하고, 옆에서 이를 제지하는 피해자 S(29 세) 의 머리를 자신의 머리로 들이받아 넘어뜨리고, 피해자 R의 다리를 발로 걸어 넘어뜨리고, L도 이에 가세하여 피해자 Q의 다리를 발로 걸어 넘어뜨린 후 피해자 Q의 얼굴을 주먹과 발로 수차례 가격하고, 옆에 있는 N도 이에 가세하여 넘어진 피해자 Q의 얼굴과 상체 부분을 발로 수차례 가격하였다.
