A defendant shall be punished by imprisonment for not less than one year and six months.
Reasons
Punishment of the crime
The Defendant, as a tenant of part of the 1st floor of the building of the 2nd floor in Gwangju-gu, Gwangju-gu, Gwangju-gu ( approximately 71.68 square meters), was entrusted with the authority to enter into a monthly rent contract for the entire 2nd floor of the 1st floor of the above building from C through C, with the intention to acquire the deposit money from the lessee after concluding a rent contract for the above building, which is known to C.
1. Crimes related to contracts with lessees E;
A. On March 26, 2016, the Defendant entered into a lease agreement with E as to the upper room of the first floor of the pertinent real estate in the “G Authorized Brokerage Office” located in Gwangju Mine-gu, Gwangju, and delivered the said agreement to E, namely, “location: D, land category, large, structure use: 2-story roof of the Gwangju Metropolitan City Mine-gu, Gwangju Metropolitan City, Gwangju, and the area to be leased: The second floor of the second floor, the area to be leased: the first floor room, the entry type, the toilet, the deposit: the KRW 1,00,00,000, the lessor: CH, and the Seo-gu, Gwangju.”
Accordingly, for the purpose of exercising authority, the Defendant forged one copy of the real estate lease agreement in the name of C, which is a private document concerning rights and obligations without authority, and issued the above contract to E who is unaware of the fact as if it was actually prepared.
B. As stated in the preceding paragraph, the Defendant: (a) was committed as the spouse of C, who is the owner of the said real estate; (b) was the public broker J and the victim E that broker broker brokered the said lease contract; and (c) was “When wife C operates a restaurant and it is impossible to conclude a direct contract so that her husband can not conclude the said direct contract, her husband will enter into the said lease contract; (b) by deceiving the victim as if he was delegated by C with regard to the said lease contract; and (c) received KRW 15 million from the victim to the agricultural bank account (L) in the name of the Defendant’s Republic of Korea on the same day.
