A defendant shall be punished by imprisonment for not less than one year and six months.
Reasons
Punishment of the crime
1. The crime committed on August 1, 2015;
A. The Defendant is a person who is engaged in driving of a motor vehicle with C low speed, in violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (i.e., an escapeing vehicle), violation of the Road Traffic Act (ii) and violation of the Road Traffic Act (iii).
On August 1, 2015, the Defendant driven the said car without obtaining a driver’s license on August 20, 2015, and led the Defendant to turn to the left at a e-mail speed from the top of the front of the 510 E-ray, Seo-gu, Daejeon to the front of the 510 E-ray, Seo-gu, Daejeon.
Since the location was a road that is parked on the street and has a lot of traffic vehicles, there was a duty of care to prevent accidents in advance by accurately operating the brakes and steering gear and preventing accidents.
Nevertheless, the Defendant neglected this and received the left part of the E-M-car driving by the injured party D (27 tax) who carried on a slowly left-hand parking as it was due to negligence, and received the left part of the E-M-car as the front part of the Defendant’s typ car.
Ultimately, the Defendant, by the above occupational negligence, sustained injury to the victim D, such as catitis that requires approximately two weeks of medical treatment, and suffered injury to the victim F (V, 24 years of age) who is the passenger of the said EM car, such as datum salt that requires approximately two weeks of medical treatment, and at the same time, escaped without taking necessary measures, such as stopping the said EM car to cause damage to KRW 450,000 of its repair cost, such as the exchange of the front driver, and providing relief to the victim.
(b) No motor vehicle which is not covered by mandatory insurance in violation of the Guarantee of Automobile Accident Compensation Insurance shall be operated on a road;
The defendant operated the above C low-priced car without mandatory insurance at the time and place specified in paragraph 1 (a).
2. The crime committed on November 8, 2015.
