Plaintiff

A (hereinafter referred to as “Plaintiff A”) entered the Republic of Korea on December 7, 2011 with a short-term general (C-2, 15 days of stay) status on December 7, 2011, and filed an application for refugee status with the Defendant on December 20, 2012. On March 5, 2013, Plaintiff B (hereinafter referred to as “Plaintiff B”) filed an application for refugee status with the Defendant on May 22, 2013.

On October 1, 2013, the Defendant issued a non-recognition of refugee status (hereinafter “instant disposition”) to the Plaintiffs on the grounds that there is no “probably-founded fear of persecution” [see Article 2 subparag. 3 of the Immigration Control Act (amended by Act No. 11298, Feb. 10, 2012); Article 1 of the Convention on the Status of Refugees; Article 1 of the Protocol on the Status of Refugees].

The Plaintiffs filed an objection with the Minister of Justice on November 4, 2013, but was dismissed on April 11, 2014.

[Ground of recognition] In the absence of dispute, Gap evidence Nos. 1 and 2 of the 2014Guhap8285 case, Eul evidence Nos. 1 and 4 of the 2014Guhap8292 case, Gap evidence Nos. 1 and 2 of the 2014Guhap8292 case, the plaintiff's husband of the plaintiff Gap asserted that the disposition of this case is legitimate, and the plaintiff's husband of the plaintiff Gap was on duty in the "E" who escorts the President's denial at the time when he was affiliated with the President's authority. On April 11, 2011, the plaintiff's son died with the plaintiff's escape and died on the same day. The plaintiff's son died with the plaintiff's mother and the plaintiff's death on the same day.
