Reasons
1. Basic facts
A. Defendant B is a person who, around August 2008, purchased real estate in the name of the company and sold it to many and unspecified persons in installments and operates planning real estate in the name of the company around August 201, 201, and around August 2013. Defendant C is a representative director of the company E, a stock companyF auditor, and a company director of G, and Defendant D is a person who has worked as a full-time director of G. 2) The Plaintiff is an employee of F Co., Ltd. on January 2, 2012.
B. Each of the instant sales contracts, etc. (1) around January 2012, the Plaintiff agreed to purchase KRW 77,420,000 of the purchase price between Defendant B and F, via Defendant B, for the purchase of KRW 331 square meters of H 331 square meters of the purchase price at port from January 27, 2012 to January 31, 2012, the Plaintiff paid KRW 77,420,000 of the purchase price (However, the sales contract for the said land was drafted on February 24, 2012).
(2) On August 2012, the Plaintiff agreed to purchase KRW 50,000,00 of the purchase price of KRW 331 square meters in Busan-gun, Busan-gun, through Defendant B, with Defendant B, and paid KRW 50,00,00,00 from September 14, 2012 to September 28, 2012.
(B) On January 24, 2013, Defendant B completed the registration of transfer of ownership in the name of the Plaintiff on January 24, 2013 as to the Plaintiff’s share of 331/1,696 square meters in J-won 1,696 square meters in Busan District Court J-gun, Busan District Court’s Dong Branch Branch Branch of the District Court.
