1. Basic facts

A. On December 17, 2015, the Plaintiff (Appointed Party; hereinafter “Plaintiff”) and the selector completed the registration of transfer of ownership on the grounds of sale due to voluntary auction on the same day with respect to each of the 1/2 shares of the Plaintiff (hereinafter “each of the instant lands”) of the Dong-dong Gdong-dong (hereinafter “Gdong-dong”) 165m2, 163m2, 473m2, and JJ large 418m2 (hereinafter “each of the instant lands”).

(B) On December 22, 2016, 1/6 of the Plaintiff’s 1/2 shares were paid to K, and 1/6 of the Selection’s 1/2 shares were paid to L, respectively.

Defendant Republic of Korea completed the registration of ownership preservation on August 26, 2002 with respect to D river 125 square meters, and E, ditch 2,707 square meters on July 26, 1989, respectively. Defendant B completed the registration of ownership transfer on April 11, 2008 with respect to F 807 square meters.

C. 1) On the ground of the instant I land, there is a mentor and a string roof, which obtained permission on October 1951, 1951. 2) M/N land located on the right side part of the H land of the instant case was replaced by a fence on the left side, and there is a factory on the side of the instant I land.

3) The left-hand side of the J land of this case adjoins the D land (land category: river category) and E land (land category: ditch). Among E land, the width of the part abutting on the J land of this case is 1.68 meters and the narrowest width of E land is 1.87 meters. 4) D, F land (land category: Jeon), and C (land category: largeer) land on the left-hand side of E.

5) Of the land E, the part between P and F land is not packaged, but is currently used as a passage available for all residents at present, and the part which has increased horizontally among the land E after passing through the said part is currently being packed and used as a road at present.
