The defendant's appeal is dismissed.

1. The decision of the court below on the gist of the grounds for appeal is too unreasonable.

2. It is recognized that the circumstances such as the Defendant’s recognition of the instant crime and reflects the mistake, and the Defendant has no record of punishment exceeding the fine imposed.

However, the crime of this case was committed by the defendant using 50 game machines to exchange in cash according to the scores obtained by customers. In light of the size of the crime and the method of the crime, etc., the defendant was punished once by a fine for the same crime. The crime related to the illegal game room is necessary to punish the defendant with severe social harm, such as the promotion of an excessive spirit of gambling by the people, and undermining sound labor awareness, etc. In addition, considering the various circumstances that are conditions for sentencing on the records, such as the defendant's age, environment, family relationship, the background leading to the crime of this case, and the circumstances before and after the crime, etc., the punishment of the court below is too unreasonable.

3. In conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the ground that it is without merit. It is so decided as per Disposition.
