1. Details of the disposition;

A. On June 7, 2016, the Plaintiffs (hereinafter referred to as “stock company” in its trade name) filed an application for permission for each electric utility business (hereinafter referred to as “instant application”) as listed below, in order to install solar power generation facilities in each forest as indicated in the “establishment site” column under the table (hereinafter collectively referred to as “instant application site”) with the Defendant and Gyeongjin-gun, Chungcheongnam-gun, Seoul (hereinafter referred to as “Ari”) (hereinafter referred to as “instant application”).

B. On August 29, 2016, the Defendant notified the Plaintiffs of non-permission regarding the instant application on the following grounds (hereinafter “instant disposition”).

The permission for the electricity business on the ground of non-permission shall meet Article 7 (5) 2 of the Electric Utility Act (which can be conducted as planned) and Article 7 (6) of the same Act and Article 7 (4) of the Enforcement Rule (the detailed criteria for the examination of the permission for the business), so that the electricity business can be implemented in accordance with the plan. However, the above place shall be non-permission in accordance with the plan for the solar power generation business of us because there is no opinion on the permission for the diversion of a mountainous district from the Ulsan-gun within the same lot area.

The Dogjin-gun has a maximum nuclear power plant (total 10 periods: 6, 2, and 2) among the local governments in Korea. The construction of ecological, cultural, and tourism cities is an area where it produces 10% of the total domestic power and 27% of the amount of nuclear power generation and contributes enormously to national energy policies.
