Reasons
Punishment of the crime
Defendant
A is a licensed real estate agent who runs the authorized brokerage business under the trade name of "E" in Suwon-si, Suwon-gu, Suwon-si, Suwon-gu, D 236, and Defendant B is a person who was an assistant of the above licensed real estate agent office.
On January 1, 201, the Defendants: (a) sought to rent a cafeteria in the Suwon-gu D shop located in the Suwon-gu Office, Suwon-gu, Suwon-si; and (b) had the Victim Gals of the said 154, 162, and 163 (total 54 square meters) mediated the lease of the said 154, 162.
The Defendants were delegated by the former lessee H, the former lessee I, and the former lessee J, 162 of the commercial building No. 154 at H, the former lessee I, and the former lessee J, 163 at the time of receiving premiums from the victims, and concluded a contract on the transfer of business rights between the victim G and the existing lessee on February 7, 201.
The Defendants, despite the fact that the Defendants received KRW 30 million from the above H, and KRW 80 million from the above J, and KRW 170 million from the above J as the premium, the amount of the premium set forth in KRW 154 to the above H is KRW 50 million, and the premium set forth in subparagraph 162 to be transferred to the above I is KRW 90 million, and the premium set forth in subparagraph 163 to the above J is KRW 80 million.
On February 9, 2011, the Defendants conspired and received 200,000,000 won from the victim to the above office as the premium for the above stores, and acquired 50,000,000 won in difference with the premium to be actually transferred to the existing lessee.
