Defendants shall be punished by imprisonment for six months.

Punishment of the crime

On November 15, 2012, the Defendants asked Defendant A to lend money to Defendant B when Defendant A received an investment of KRW 20,000,000,000,000 from Defendant A, which is located in Mapo-gu Seoul Metropolitan Government Office for the settlement of disputes, and Defendant B asked Defendant A to pay KRW 1,50,000 per month the victim F to the above office, and Defendant A received an investment of KRW 20,000,000 from the victim, and Defendant A also expressed that he received an investment of KRW 20,000,000,000,000,000 from the victim.

As a result, Defendant B took the victim F into the office of Defendant A, and invested KRW 20 million in the funds necessary for the production of the E-game machine to Defendant A, Defendant B would be able to receive revenue of KRW 1.5 million per month from Defendant A, and Defendant A would have received KRW 20 million from the victim as if monthly revenue was paid from the victim, and prepared an investment contract with the same content to the victim.

However, even if the Defendants received KRW 20 million from the victim, they thought that they would deliver the money to Defendant B to use it as personal funds of Defendant B, and did not think that they would use it for Defendant A’s game producing business, and did not have any intent or ability to complete payment even if they received money from the victim.

Nevertheless, the Defendants conspired to induce the victim and received 20 million won as investment money from the victim's place of business by deceiving the victim.
