A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The defendant is not a person handling narcotics.
1. Sale and purchase of phiphones;
A. On March 1, 2020, the Defendant collected money with D and E in the Defendant’s residence of the Seo-gu Incheon Seo-gu building C, Seo-gu, Incheon, and intended to administer psychotropic drugs by purchasing a psychotropic drug camera (one philophone, hereinafter referred to as “philophone”), and issued 250,000 won to Handphone sellers and purchased 0.5 g of philophones.
Accordingly, the defendant, in collusion with D and E, sold approximately 0.5 gramphones.
B. On April 1, 2020, the Defendant collected money together with D and E at the Defendant’s residence and decided to administer philophones, and then issued KRW 250,000 to F, and purchased approximately 0.5 g of philophones.
Accordingly, the defendant, in collusion with D and E, sold approximately 0.5 gramphones.
C. On April 13, 2020, the Defendant: (a) collected money from the E’s residence located in Kimpo-si G with D, E, and a person with no name (hereinafter “H”); (b) decided to purchase and administer philophones; (c) delivered KRW 150,000 to the philophone sellers and purchased approximately 0.3 grams of philophones.
Accordingly, the Defendant sold approximately 0.3g of philophones in collusion with D, E, and the person with no name.
2. Medication of phiphones.
A. On March 1, 2020, the Defendant administered the volume of philophones in a way that puts the volume of the philophones purchased from the Defendant’s residence, as described in paragraph 1(a), into a glass pipe, and ends up the smoke generated from fluoring the fire on the bottom.
B. Around April 1, 2020, the Defendant administered philophones in a way that puts the volume of philophones purchased from the Defendant’s residence as described in paragraph 1(b) into a glass pipe and ends up the smoke generated from fluoring a fire on the bottom.
C. The Defendant, around April 13, 2020, at the Kimpo-si G around Kimpo-si’s residence, planned as described in paragraph (1)(c) with a favorable pipe.
