A. Defendant’s claim for return of membership fees and grant of an execution clause 1) The Defendant paid a total of KRW 250 million to C by November 17, 2006, and attended as a regular member of “E” operated by C. 2) on November 20, 2011, the Defendant filed a lawsuit against C seeking the return of membership fees under the 2014Gahap668 with the Jeonju District Court Military Branch Branch 2014Gahap 20168, and on July 3, 2014, the said court rendered a judgment that “C shall pay 250 million won to the Defendant and 200% interest per annum from April 8, 2014 to the date of full payment,” and the said judgment became final and conclusive on July 22, 2014.

(3) As to the instant final judgment, the Defendant filed an application for grant of the succeeding execution clause on the ground that the Plaintiff succeeded to the obligation to return the membership fee to the Defendant by C, and the chief clerk of the court, chief clerk H H of the court, upon the order of the judicial assistant officer, pursuant to the order of December 15, 2014, the succeeding execution clause with the Plaintiff as C’s successor (hereinafter “instant succeeding execution clause”).
