Punishment of the crime

1. No person who violates the Electronic Financial Transactions Act shall transfer or acquire a means of access in using and managing the means of access;

A. Despite Defendant A’s sole criminal conduct, on December 2014, the Defendant: (a) sent the means of access to electronic financial transactions by delivering a passbook and cash card connected to the Defendant’s name-based bank account (H) to the next police officer on the Internet advertisement stating that “The Defendant shall grant a commission to sell a passbook to be used at an illegal soil site; and (b) to the non-person in charge of reporting the Internet advertisement; and (c) on the same day, in front of the Bupyeong-gu Incheon Bupyeong-gu square, Incheon, the Defendant sent the means of access to electronic financial transactions by visiting the person in charge of receiving the above name-paid box or having the passbook and cash card connected to

B. On May 19, 2015, Defendant A and Defendant B conspired with each other to contact an Internet advertisement stating that “one million won will be paid if the passbook to be used for the purpose of the game exchange is transferred,” and to transfer the passbook at the front of the sand-based market located in Dongdaemun-gu Incheon Metropolitan City. On the same day, Defendant A and Defendant B sent the passbook connected to the new bank account in the name of Defendant B (I) and the cash card to a home-based engineer who sent the above bearers, and transferred the means of access to electronic financial transactions.

C. On May 31, 2015, Defendant A, Defendant B, and Defendant C conspired to purchase a passbook in front of the sand market located in the Dong-gu Incheon Metropolitan City, and agreed to transfer the passbook to a person with no name, who opened an Internet advertisement and opened the passbook. On the same day, the passbook connected to the Defendant C’s name foreign exchange bank account (Account No. 1) and the cash card were delivered to the online sales officer who sent the above and transferred the means of access to electronic financial transactions.
